Terms & Conditions

These are the legal terms and conditions under which we supply the products listed on our website, https://www.hairtalk.com.au, to you. Please read these Terms and Conditions carefully before ordering any products from our website. Where you use and continue to use our website you are indicating that you accept and continue to accept these Terms and Conditions and our Privacy Notice, irrespective of whether you order through Hairtalk or register with us. If our Privacy Notice or Terms and Conditions are not acceptable to you, please do not use our website.

WHO ARE YOU?

You can only purchase products from our website if you are a legally capable (i.e. over the age of 18 without incapacity) of entering a binding contract with us, you are the properly authorised user of the credit or debit card or payment account used to pay for your order and are resident in a country that we are permitted to deliver to.

 

PAYMENTS
 

Orders can be made via our online store once you have been registered and approved as a member, or alternatively via email or phone. Payments can be made by Visa, MasterCard, American Express or PayPal. Upon payment being cleared your order will be processed immediately. All credit card holders are subject to validation checks and authorisation by the card issuer.

 

We can change the prices on our site at any time without notice, but changes will not affect orders which we have already accepted. However, if the rate of GST changes after the date of your order, we will adjust the rate of GST you pay unless you have already paid for the Products in full before the change in GST takes effect.

 

SHIPPING AND DELIVERIES

All orders we receive that are correctly placed are processed within 24 hours. We will endeavour to have your items to you as soon as reasonably possible although deliveries range between 1- 7 days depending on where you are in Australia or New Zealand. In any event, delivery will take place no more than 30 days after the day your Order is made and the contract entered into. If no one is available at your address to take delivery and the Products cannot be posted into a letterbox or left in a safe space, after three attempts, we may end the contract and the Events Beyond our Control clause below will apply. Delivery of the product will be complete as at the time we deliver the products to the address you gave us and the Products will be your responsibility to care for and maintain in accordance with the Maintenance and Care FAQ. You will own the Products as at the point in time we have received full payment in cleared funds. Any orders placed on a weekend will be processed on the following Monday. RIGHTS RESERVED
 

We reserve the right to cancel any order made by any means at any time. We will notify this action by email or phone using the details that you have provided. We will refund the monies paid using the original method received. All orders are subject to availability of stock.

 

PRODUCT IMAGES AND DESCRIPTIONS
 

Our descriptions and pictures of our products displayed on our website are solely for illustrative purposes. Your products may vary slightly from our descriptions or images. We do make every effort to display and describe the colours and other features of the products accurately. We cannot guarantee that your computer or mobile screen or printed images we create, accurately reflect the colour of the Product that you will receive.

 

RETURNS
 

If you are seeking to return a product you have purchase from us, you must do so in accordance with our Returns Policy.

 

PROMOTIONS AND DISCOUNTS
 

From time to time Hairtalk runs online exclusive offers. To redeem an online-only offer the order must be placed and paid for via our website shop www.hairtalk.com.au Orders placed via email or phone will not be eligible for the discount. Discount code must be applied at checkout to redeem the offer. It is the customer's responsibility to ensure that discount code is entered at the time of placing an order. The code cannot be applied after you have submitted your order. Discounts cannot be used in conjunction with any other offer. Certain offers are subject to additional terms - refer to the current offer to view specific terms such as exclusions, valid products, and available timeframes. All references to times and dates are based on AEST.

 

INTELLECTUAL PROPERTY, COPYRIGHT AND TRADEMARKS
 

You agree that all copyright, designs, trademarks, images and all other intellectual property and material rights relating to the content as described, including Hairtalk Software and other code contained in this website, shall remain at all times vested in Hairtalk and are the property of their respective owners. All such content, including third party trademarks, designs and related intellectual property rights mentioned or displayed on this website are protected by national intellectual property and other laws and international treaty provisions. Any reproduction or redistribution of the above described content is prohibited and may result in criminal penalties. Violators will be prosecuted to the fullest extent possible. Copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited.

 

EVENTS OUTSIDE OUR CONTROL
 

We will note be liable or responsible for any failure to perform, or delayed performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control means any act, event, omission or accident beyond our reasonable control. If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract, we will contact you as soon as reasonably possible to notify you and our obligations under the Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over. You may cancel a Contract affected by an Event Outside Our Control if there is a risk of substantial delay. WAIVER
 

Any delay by us in enforcing our rights under these Terms and Conditions are not taken to be a waiver of our rights. Any waiver by us of rights against you may only be made expressly in writing and signed by an authorised member of Hairtalk Australia.
